Terms and Conditions
Kismet UK is a trade-name of Kismet Development Ltd (“KDL”). KDL operates various websites ("Website") under the www.kismetuk.com and other URLs.
Kismet UK offers various products and services, including the organisation of and attendance at events and information, software, products, services and content available via the Website, which may be paid or unpaid (“Service”). By booking or using the Service you become a Kismet UK user (“User”). The Service is offered to you, the User, conditional upon your acceptance without modification of the Terms and Conditions (“T&Cs”). Your booking or use of the Service constitutes your agreement to be bound by the T&Cs and you represent and warrant that you have the right, authority and capacity to make this undertaking.
Privacy Policy
Kismet UK respects and values your privacy. We will thereby operate by the following conditions:
- Any information that you provide us that personally identifies you ("Personal Information"), e.g. your name, e-mail address and other such information will not be passed to outside companies to send you information about their products or services.
- Personal Information will not be disclosed to other Users without your consent except when booking for an event your name may be published as a potential attendee at that event; however no other Personal Information will be made available without your consent.
- Personal Information may be used by Kismet UK at any time to promote the events, services and products of Kismet UK or sister organisations including any subsidiary or associated organisation of Kismet Development Ltd. Kismet UK may also disclose your Personal Information to partner organisations to provide services in conjunction with Kismet UK or third parties with whom we are seeking to develop or create partnerships.
- The purpose of Kismet UK is to provide a medium by which people seek to network, learn about and make contact with each other. Information that is entered into areas of KismetUK.com that are viewable by another user or a casual visitor to the website do not constitute Personal Information and are not subject to the terms of the Privacy Policy.
- Kismet UK may disclose general information about its Users (consolidated by various categories such as age, gender, profession, geographic location etc), but not individual Personal Information, to third parties without the consent of any User.
- If you arrive at another website via a hyperlink from Kismet UK.com, any transaction that you make on that website is completely independent of and outside of the responsibility and control of Kismet UK and subject to the terms and conditions and/or privacy policy of that site rather than the terms or conditions and/or privacy policy of Kismet UK.
- Kismet UK may use cookies or other similar software to collect data about users to track their movements around the Website and in order to assist those users to automatically and more easily use the Website on each subsequent occasion.
- Users may unsubscribe from the services and email list of Kismet UK as required.
- If at any time you believe that Kismet UK has not adhered to these conditions, please notify us by email (to abuse@KismetUK.com ) and we will use all reasonable efforts to investigate and correct any problem.
Rights and Responsibilities of the User
Users may not assign or transfer any Service to any other person or entity other than the User to whom the Service has been agreed to be provided.
Users must promptly inform Kismet UK of the following: changes in the validity of any credit card used in connection with the Service including without limitation changes in home or billing address.
KismetUK.com makes use of IDs and associated passwords in the provision of Service. Each User must keep their ID and associated password strictly confidential. Kismet UK will not release personally selected passwords to anyone other than the User for any reason, except as may be specifically required by authorised legal authorities. Users must promptly inform Kismet UK about any apparent breaches of security, such as loss, theft, or unauthorised disclosure or use of an ID and associated password. Users will remain liable for any unauthorised use of the Service until Kismet UK have been informed by telephone and in writing and have subsequently disabled access to the Service. Unauthorised access to the Service is a breach of these T&Cs.
In consideration of your use of the Service, you agree to provide and keep current true, accurate and complete information about yourself as prompted by the Service's various registration forms. If you provide any information that is untrue, inaccurate, not current or incomplete or Kismet UK has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Kismet UK has the right to suspend or terminate your Service and refuse any and all current or future use of the Service (or any portion thereof).
You acknowledge that all information, data, text, software, music, sound, photographs, graphics, video, messages and other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you the User and not Kismet UK are entirely responsible for all Content that you upload, post, email or otherwise transmit via the Service. Kismet UK does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You acknowledge that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Kismet UK be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the Service. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by Kismet UK or submitted to Kismet UK in any and all parts of the Service.
You agree to not use the Service to: upload, post, email or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; impersonate any person or entity, including, but not limited to, a Kismet UK representative, or falsely state or otherwise misrepresent your affiliation with a person or entity; forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service; upload, post, email or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships; upload, post, email or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party; upload, post, email or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except as specifically permitted in areas that are designated for such purpose; upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; interfere with or disrupt the Service in any way including, but not limited to, actions that may degrade the experience of other Users; interfere with or disrupt the servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; intentionally or unintentionally violate any applicable law or regulation; "stalk" or otherwise harass another; or collect or store personal data about other users. You acknowledge that Kismet UK does not pre-screen Content, but that Kismet UK and its designees shall have the right (but not the obligation) in their sole discretion to refuse or move any Content that is available via the Service. Without limiting the foregoing, Kismet UK and its designees shall have the right to remove any Content that violates the T&Cs or is otherwise objectionable.
Termination
You agree that Kismet UK in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if Kismet UK believes that you have violated or acted inconsistently with the letter or spirit of the T&Cs. Kismet UK may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of the T&Cs may be effected without prior notice, and acknowledge and agree that Kismet UK may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that Kismet UK shall not be liable to you or any third-party for any termination of your access to the Service.
The User may request termination of Service upon notification to Kismet UK by electronic or conventional mail. When a User requests termination or when Service is terminated by Kismet UK as a result of a breach of these T&Cs, any Service booked and paid in advance is non-refundable except at the absolute discretion of Kismet UK .
General Practices Regarding Use and Storage
You acknowledge that Kismet UK may establish general practices and limits concerning use of the Service, including, but not limited to, the maximum number of days that email or other messages, or other uploaded Content will be retained by the Service, the maximum number of messages that may be sent from or received by a User, the maximum size of any message that may be sent from or received by a User, the maximum disk space that may be allotted to the User and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree that Kismet UK has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Service. You acknowledge that Kismet UK reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that Kismet UK reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.
Events
Kismet UK reserves all rights of admission to it's events. You may be barred from entering or attending a particular event or future events or ejected from an event, with or without warning, for any breach of the T&Cs or any other behaviour that may be considered unreasonable according to generally accepted standards. This includes, but is not limited to: violation of any previously stipulated dress code or dressing in a manner that is not consistent with the professional image of Kismet UK or that could be considered as lacking in decency; excessive drunkenness; behaviour likely to cause embarrassment to a reasonable person or unreasonably restricting the freedom, rights, personal space or enjoyment of others; abusive or threatening behaviour; you have previously been informed that you are barred from a particular event or events; you are not the person for whom the booking has been made, or to whom the Service has been agreed to be provided or cannot provide suitable proof of such.
All complimentary tickets, prizes, discounts, awards, giveaways, free or discounted offers etc; shall be strictly non-transferable, non-combinable and provided at the sole discretion of Kismet UK in accordance with whatever restrictions it sees fit to apply.
Kismet UK does not allow the distribution of flyers or any other advertising material in and around it's events except by sponsors with it's specific written agreement.
Kismet UK events are held at public venues, owned or operated by establishments that have their own rules and regulations that are outside the control and authority of Kismet UK. You are obliged to follow the rules and regulations associated with each venue and establishment and Kismet UK cannot be held responsible in any way for any consequences resulting from your failure to do so. In the event that you suffer any injury, loss or damage as a result of attending a Kismet UK event at a public venue you agree to release Kismet UK and its associates from any liability with respect thereof and pursue any claims you may have directly with the venue and/or establishment concerned.
Users can be held responsible for the behaviour and actions of others for whom they have made a booking.
Photographs may be taken at events and all rights relating to such shall be retained by Kismet UK and exercised at it's sole discretion including the right to display such photographs on the Website, other websites and in any other promotional material. Should a User have an objection to the use of a particular photograph, Kismet UK may at it's sole discretion choose not to use this if it considers any objection to have merit. Users may from time to time be able to purchase or be given copies of photos taken by Kismet UK or it's duly authorised nominees, the rights associated with such shall be limited to that copy of the photo and not any right or title to the original which shall remain with Kismet UK at all times.
If admission to an event is refused or a person is ejected from an event as a result of any of the above conditions, any booking or admission fee paid in advance is non-refundable except at the absolute discretion of Kismet UK .
Cancellation Policy
All amounts paid in advance shall be non-refundable if cancellation is requested by the User or results from a failure to observe the T&Cs.
Subject to the deduction of any administration costs incurred, any conditions imposed by suppliers on Kismet UK and any resulting losses thereof, Kismet UK may, at its sole discretion, issue part refunds for cancellation requests brought to it's attention within a reasonable period of time. Any refunds given will only apply to fully paid bookings and not to any deposits or part paid bookings.
The following is a guideline and will not apply in all cases, for information specific to a particular event please refer to or request information on that event.
Cancellations more than one month in advance could qualify for a 90% refund subject to a minimum cancellation fee of £10 per person.
Cancellations more than one week in advance, but less than one month, could qualify for a 75% refund subject to a minimum cancellation fee of £25 per person.
Cancellations more than 48 hours in advance, but less that one week, could qualify for a credit against bookings for a future event, within the following six months, of up to 50% of the amount paid per person.
Cancellations less than 48 hours in advance will not normally receive any refund but should be advised to Kismet UK as soon as possible in case organisational arrangements need to be adjusted.
Meeting People
Kismet UK aims to provide people with the opportunity to meet one another in a safe and relaxed environment at our events and encourages Users of our Service to behave in an honest, responsible and reasonable manner towards other Users at all times. However we are not responsible or liable in any way for the accuracy or otherwise of any information provided by Users or for their behaviour and actions either at our events or in general. Please take all reasonable precautions for your safety and in protecting your personal information when meeting people through our Service as you would when meeting any stranger whether at one of our events or elsewhere. It is your responsibility to verify any information provided by Users of our Service to your own satisfaction and take all necessary precautions for your safety and well-being.
As a User of Kismet UK you agree that neither Kismet UK nor its associates is liable in any way for any injury, loss or damage, direct or indirect, that may arise from the use of the Service, including, but is not limited to, that arising from communicating with other Users. Such injury, loss or damage may include, but is not limited to, physical damage or theft of property, bodily injury and/or emotional distress and discomfort.
Limitation of Liability
Any liability on the part of Kismet UK including, but not limited to, any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, alteration of, or use of records, whether for breach of contract, tortuous behaviour, negligence, or under any other cause or action, shall be strictly limited to the amount paid by or on behalf of the User to Kismet UK for that event, product or service or in the case of a paid subscription to the amount paid for the preceding 12 months, or part thereof.
Personal and Non-Commercial Use Limitation
Kismet UK is for your personal and non-commercial use. You may not copy, modify, distribute, display, perform, create derivative works from, transfer or sell any information, software, products or services obtained from KismetUK.com whether printed, visual, audio, radio, electronic, email forwarding, TV, satellite, digital transmission, scanned, website re-cycled or any other form of material except where expressly noted that the material is available for such purpose.
Kismet UK is not to be used for purposes of professional recruitment, Users cannot utilise the information provided to charge for recruitment services or approach Users to change jobs.
No Unlawful or Prohibited Use
As a condition of your use of this Website, you warrant to Kismet UK that you will not use this Website for any purpose that is unlawful or prohibited by these T&Cs.
Indemnity
You agree to indemnify and hold Kismet UK and its associates, subsidiaries, affiliates, officers, agents, co-branders and other partners, and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of Content you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the T&Cs, or your violation of any rights of another.
Software
Software and/or any programming code that is used to provide the Website and/or Service or made available to download from the Website ("Software") is the copyrighted work of Kismet UK and/or its suppliers. Your use of the Software, if allowed at all, is governed by the terms of the end user license agreement ("License Agreement"), if any, which accompanies or is included with the Software. You may not install or use any Software that is accompanied by or includes a License Agreement unless you first agree to the License Agreement terms. For any Software not accompanied by a License Agreement, Kismet UK hereby grants to you, the User, a personal, non-transferable license to use the Software for viewing and otherwise using the Website in accordance with these terms and conditions, and for no other purpose. Please note that all Software and programming code used as part of the Website, is owned by Kismet UK and/or its suppliers and is protected by copyright laws and international treaty provisions. Any reproduction or redistribution of the Software is expressly prohibited by law and may result in severe civil and criminal penalties.
Dealings with Advertisers and Merchants
Your correspondence or business dealings with, or participation in promotions of, advertisers and merchants found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser or merchant. To the fullest extent permitted by applicable law, you agree that: Kismet UK shall not be responsible or liable for any loss or damage of any kind incurred as the result of any such dealings or as the result of the presence of such advertisers and merchants on the Service, and any orders placed by you on, and any product specifications and product availability appearing on, the Service are subject to confirmation by, and the terms and conditions of business of, the relevant Merchant.

You further acknowledge and agree that Kismet UK shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.
Liability Disclaimer
The information, software, products, services and content available via the Website may include inaccuracies and typographical errors or may be otherwise incomplete. Kismet UK and its associates may from time to time make changes and improvements to the Website.

Kismet UK's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement shall limit or hinder Kismet UK's right to comply with law enforcement requests or requirements relating to your use of the Service or information provided to or gathered by Kismet UK with respect to such use.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
This agreement constitutes the entire agreement between the user and Kismet UK with respect to this Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and Kismet UK with respect to this Website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Fictitious names of companies, products, people, characters and/or data that may be used herein are not intended to represent any real individual, company, product or event.
